Terms of Service

These Terms of Service form an agreement between the employment advertiser ( also referred to as “the Advertiser”) and Jobs Europe AB (with organization number 559370-9347, also referred to as “Jobs Europe”) regarding the Advertiser's use of Jobs Europe's services ( also referred to as “Jobs Europe's Services”).

  1. Authority. Through the action of purchasing and/or ordering Jobs Europe’s Services, the purchaser ensures its authority to enter into agreement with Jobs Europe on the Advertisers’ behalf.

  2. Services. Jobs Europe's Services include four types of subscriptions: "Basic", "Standard", "Premium", and "Recruiter". The "Basic" subscription provides access to recruitment advertisements on Jobs Europe's websites. The "Standard" subscription provides access to recruitment advertisements and the ability to publish a "company page" on Jobs Europe's websites. The "Premium" subscription also includes access to recruitment advertisements and the ability to publish a "company page" on Jobs Europe's websites, as well as the ability to submit and publish blog articles on Jobs Europe's website. The "Recruiter" subscription is exclusively available for eligible customers, who are defined as those who are currently employed or contracted by a Jobs Europe “Premium” or “Standard” subscription holder and only for that subscriber's specific location. Each subscription is valid for one (1) country only. The first subscription held by the Advertiser uses the country where the Advertiser has its registred office as the assigned country and can only be changed after written confirmation from Jobs Europe. Additional countries can be added for an additional fee.

    Each subscription has a set duration (also referred to as the Billing period) and renews automatically with its corresponding duration unless canceled by the Advertiser before the end of the Billing period. Cancelation is made through the Client Portal / Dashboard. The subscriptions have the following Billing periods:

    1. Basic, 30 days
    2. Standard, 180 days
    3. Premium, 365 days
    4. Recruiter, 30 days

    The first Billing period starts on the Purchase date. The Purchase date is defined as the date when the Advertiser signed the quotation related to these Terms of Service or in case of payment through credit/debit card, it's the date when the order was placed through the Jobs Europe website.

    If Jobs Europe offers a free trial of the Premium subscription, the Purchase date is defined as the date when the trial ends. The trial ends on the conclusion of the 14th day counted from the date when the Advertiser signed the quotation related to these Terms of Service or in case of payment through credit/debit card, the date when the order was placed through the Jobs Europe website.

    Subsequent Billing periods begin on the date immediately following the conclusion of the last day of the current Billing period.

    It is important to note that once the Advertiser's order is received by Jobs Europe, it is binding.

  3. Campaign services. Jobs Europe offers additional employment marketing services under the name “Campaigns”. The Advertiser can purchase Campaign services in addition to the subscription services under the campaigns tab inside the Jobs Europe Client Portal at an additional cost. A campaign can consist of a combination of the following services: Display Banners, Digital Marketing Campaigns (Also known as SocialReach Campaigns), and Email Marketing Campaigns (Also known as Email Sendouts or Job Boost).

    Display Banners are marketing banners that are all available on Jobs Europe's website. These can be either Home Page Banners, Country Page Banners or Language Page Banners. Home Page Banners are visible on the home page, Country Page Banners are visible on a specific country page and Language Page Banners are visible on a specific language page. All Display Banners run for an entire calender month with the start date on the first of the month that was orderd by the Advertiser. For example, if the Advertiser ordered a Home Page Banner to run in April 2024 then the start date would be the 1st of April 2024 and it would conclude on the last day of April 2024.

    SocialReach Campaigns are marketing campaigns that are run on media platforms such as Facebook, Instagram, LinkedIn , Google and on Jobs Europe's Partner Network, depending on which tier the Advertiser chooses. These are offered in the tiers of Bronze, Silver and Gold each with their respective features and pricing as outlined in the campaigns tab inside the Client Portal. The Advertiser can choose to run a SocialReach Campaign for a specific job advertisement or language and country.

    Once a Campaign has been ordered by the Advertiser it is binding and the Advertiser is obligated to pay for the Campaign in its entirety. A Campaign can be ordered through the Client Portal or by email. Jobs Europe reserves the right to refuse to run a Campaign or run part of a Campaign if the Advertiser has unpaid invoices with Jobs Europe or if the Advertiser has violated the Terms of Service or if the campaign can be in conflict with these Terms of Service or Jobs Europe's Privacy Policy or any applicable law. Moreover, Jobs Europe reserves the right modify the Campaign in order to comply with the Terms of Service or Jobs Europe's Privacy Policy or any applicable law.

    In the event that part of a Campaign is not available due to a double booking Jobs Europe will first offer an alternate date for the item in question. If the Advertiser does not accept the alternate date then Jobs Europe will refund the Advertiser for the part of the Campaign that was not available if its already been paid for. If the Advertiser has not paid for the part of the Campaign that was not available then Jobs Europe will not charge the Advertiser for that part of the Campaign. Jobs Europe will not be held liable for any damages that may occur to the Advertiser due to the unavailability of part of a Campaign.

    If a Campaign is not available due to a technical issue on Jobs Europe's side then Jobs Europe will refund the Advertiser for the part of the Campaign that was not available if its already been paid for. If the Advertiser has not paid for the part of the Campaign that was not available then Jobs Europe will not charge the Advertiser for that part of the Campaign. If the technical issue is beyond the control (E.g power outage or issue at third party vendor) of Jobs Europe then Jobs Europe will not be held liable for any damages that may occur to the Advertiser due to the unavailability of part of a Campaign.

  4. Terms of payment. Payment can be made either through invoicing or through debit/credit card payment. In case of payment through debit/credit card the Advertiser pays upfront for the services. Jobs Europe reserves the right to require payment through invoicing in case the Advertiser has selected payment through debit/credit card and fails to provide payment when required to do so and has not cancelled their subscription(s) as outlined in section 2 of these Terms of Service. In case of invoice payment, the invoice must be paid before or on the stated due date which is 30 days from the invoice date, unless otherwise agreed upon in writing and made apparent on the invoice. In case of late payment, Jobs Europe reserves the right to charge a late payment fee of 30 euros (EUR) as well as adding interest at the time applicable Swedish Central Bank reference rate (Riksbankens referensränta) + 5%. Jobs Europe reserves the right to immediately suspend access to all of Jobs Europe's services and delete any published job advertisements or blog posts if the Advertiser fails to pay in accordance with these Terms of Service. Furthermore, Jobs Europe can require upfront payment before granting access to any of its services and refuse access to any Advertiser who has unpaid invoices with Jobs Europe.

  5. Requirements.

    Advertisement requirements

    All Job Advertisements are subject to continuous review and Jobs Europe's job posting content policies in order to ensure that jobs posted on the website are available, relevant and accurate. Jobs Europe has the right to change content of submitted and published Job Advertisements in order to comply with the job posting content policies. The Advertiser promises not to: Submit to Jobs Europe, job advertisements or other material that violates the GDPR or Jobs Europe's Privacy Policy. Gather data other than the number of applicants from Jobs Europe's Services. Transmit or make available Jobs Europe's Services on any other platform. Undertake such actions that heavily burdens Jobs Europe's digital infrastructure or aims to take advantage of any weaknesses in the security of Jobs Europe's Services. Job posting content policies The Advertiser agrees to comply with the following job posting content policies: The Job Advertisement cannot: be in conflict with EU law, including the GDPR, contain obscene, profane, or offensive language, contain false location data that does not reflect the actual location of the job, contain non-existing jobs, utilize bad SEO practises such as keyword stuffing to manipulate search rankings, contain advertisements disguised as a job posting, be expired, be posted without a way to apply, such as broken links to the Advertiser's website, omit to include a description of the open position, needed qualifications and other relevant information for a potential job seeker, require the applicant to pay for applying to the job or conduct tests to be considered for the job, contain excessively grammatically incorrect use of language, this includes but is not limited to misuse of proper punctuation, capitalization or uncommon acronyms or abbreviations, have the sole purpose of collecting CVs for not yet published roles, The Job Advertisement has to: be language based, or require a specific language skill from the job applicant, Any damages, direct or indirect, that are inflicted upon Jobs Europe through the posting of job advertisements that conflict with the job posting content policies and/or Terms of Service shall be compensated by the Advertiser in full. Jobs Europe has the right to refuse to post any job advertisement that it deems to in any way damage the Jobs Europe brand, company or the interest of the job seekers.

    Company Page

    As part of the “Premium” and “standard“ subscription, the Advertiser may upload content to a “company page” on Jobs Europe's website. The Advertiser agrees to comply with the following requirements: The company page cannot: be in conflict with EU law, including the GDPR, contain obscene, profane, or offensive language, contain non-existing jobs, utilize bad SEO practices such as keyword stuffing to manipulate search rankings, contain advertisements, contain links to sites other than those who are controlled by the Advertiser, include links to site that are pornographic in nature or criminal, contain excessively grammatically incorrect use of language, this includes but is not limited to misuse of proper punctuation, capitalization or uncommon acronyms or abbreviations, have the sole purpose of collecting CVs for not yet published roles, Jobs Europe reserves the right to modify the Advertiser's company page without any prior notification for the purpose to adhere to the company page policies or to improve what Jobs Europe considers to improve the end user experience. Blog articles As part of the “Premium” subscription, the Advertiser may submit content to a blog on Jobs Europe's website. The Advertiser agrees to comply with the following requirements: The blog article cannot: be in conflict with EU law, including the GDPR, contain obscene, profane, or offensive language, contain non-existing jobs, utilize bad SEO practices such as keyword stuffing to manipulate search rankings, contain advertisements, contain links to sites other than those who are controlled by the Advertiser, include links to site that are pornographic in nature or criminal, contain excessively grammatically incorrect use of language, this includes but is not limited to misuse of proper punctuation, capitalization or uncommon acronyms or abbreviations, have the sole purpose of collecting CVs for not yet published roles, Jobs Europe reserves the right to modify the Advertiser's blog article without any prior notification for the purpose to adhere to the blog requirements or to improve what Jobs Europe considers to improve the end user experience.

  6. Jobs Europe's responsibility. Jobs Europe assumes no responsibility for the accuracy of the information posted on its website, including job advertisements and company pages. No obligation is placed upon Jobs Europe to take action against an Advertiser that violates the Terms of Service. No guarantees regarding functionality or availability of Jobs Europe's Services is made. Jobs Europe shall not be held liable for any damages that may occur to the Advertiser due to lack of functionality or availability of Jobs Europe's Services. No responsibility for the outcome of the Advertiser's job advertisements can be taken by Jobs Europe and the Advertiser understands that the results, including number of visitors and application for any given job advertisement can vary.

  7. Right to marketing. Jobs Europe has the right to make available the Advertisements published by the Advertiser on other networks such as other job posting websites, public or private.

  8. Jobs Europe's IP. Jobs Europe's intellectual property rights (IP) include but are not limited to, films, advertisements, illustrations, logos, information, images, web applications, software, audio, design, copy, illustration and text. Jobs Europe's intellectual property rights are the sole property of Jobs Europe and may not be registered by the Advertiser. All use of the IP by the Advertiser must be approved in writing by Jobs Europe in advance. Any unauthorized use of the IP is a violation of the Terms of Service and a possible copyright infringement.

  9. The Advertiser's IP. By uploading or otherwise distributing any images, films, logos, text, audio, design and illustrations (hereafter “the Material”) by the Advertiser to Jobs Europe the advertiser confirms that: the Material is either the intellectual property of the Advertiser or that the Advertiser has all of the permissions necessary of any third party intellectual property owner to share with Jobs Europe, Jobs Europe may use the Material in Jobs Advertisements or on the Advertiser Company page on the Jobs Europe website or any other relevant part of Jobs Europe's website or affiliated sites, Jobs Europe may modify the Material in such ways that it displays properly and in uniform with the overall design of the website.

  10. Force Majeure. Jobs Europe is exempt from any sanction for failure to fulfill its obligations, if the failure is due to circumstances beyond Jobs Europe's control and that Jobs Europe could or should not reasonably have foreseen at the time of ordering the Service, e.g. war, civil war, fire, flood, interruptions in public transport, disruption of public energy supply or similar circumstances.

  11. Changes of Terms of Service. Jobs Europe has the right to modify the Terms of Service. Any changes to the Terms of Service will be made available on Jobs Europe's website. Existing customers are automatically bound by the new provisions in the Terms of Service 30 days after publication on the website. Any updates to the Terms of Service replaces prior versions of the Terms of Service.

  12. Omission. Inaction on any deviation made by the Advertiser in relation to the Terms of Service, shall not mean that Jobs Europe has waived its rights, or that the Terms of Service are invalid or modified.

  13. Invalidity of provision. The Terms of Service shall not be deemed invalid in its entirety if any single provision in these Terms of Service should be ruled invalid. If any single provision is deemed invalid then the Parties can first attempt to agree on a new provision. If no agreement can be reached, the invalid provision(s) shall be considered removed and valid provisions shall continue to apply.

  14. Handling of personal data. Jobs Europe handles personal data received in connection with the Advertiser's use of Jobs Europe's services. Such handling is made in accordance with Jobs Europe's Privacy Policy. By the Advertiser's use of Jobs Europe's services, the Advertiser is considered to have agreed to Jobs Europe's Privacy Policy.

  15. Communication. Communication between the Advertiser and Jobs Europe should primarily be conducted via email between representatives of each respective entity.

  16. Complaints. In order to be valid, claims for compensation must be directed to Jobs Europe within thirty (30) days from the date on which the Advertiser became aware, or should have become aware, of the fact on which the claim is based.

  17. Liability. The Advertiser cannot invoke any other remedies against Jobs Europe than stated in the Terms of Service. Jobs Europe's liability is in any event limited to direct damages and shall not include indirect damages.

  18. Dispute resolution. Swedish law shall apply to these Terms of Service. Disputes arising from the Terms of Service shall be settled by the Swedish court where Jobs Europe has its registered office.
